Is it legal to have a prairie dog pet or a groundhog in Houston, TX? Where can I buy one and how?
I a store to pet a few years ago in Sugar Land, TX and they were prairie dogs. Or marmots. I forgot it there is a difference or not, but I wanted one, but they were not yet on sale because of pending legislation. I want to buy one, but I do not know where to get them if they are obtained, even in the short to steal a baby of a family nature. If they are obtained, how are they?
Houston a ban on wild animals. I do not know if the marmots fall below. I would suggest you contact the animal control and ask them. Here is a small portion of the law. ARTICLE III. KEEPING WILDLIFE * Sec. 6-51. Wild animal defined. In this section, the term on the wild animal means any mammals, amphibians, reptiles or birds of a species that is wild by nature and that, because of its size, vicious nature or other characteristics, is dangerous to humans. These animals include but are not limited to, lions, tigers, leopards, panthers, bears, wolves, dog-wolf hybrid, cougar, coyote, coyote hybrid dogs, raccoons, skunks (whether or not deodorized), monkeys, gorillas, monkeys of a species whose average adult weight is 20 pounds or more, foxes, elephants, rhinos, alligators, crocodiles, alligators, poultry than a macaw, all forms of poisonous reptiles and other snake that will grow to a length more than eight feet. The term also includes any animal classified as "species threatened "under the federal Endangered Species Act of 1973, as amended, or other birds protected by the federal government Treaty on migratory birds. The term wild animal shall not include gerbils, hamsters, Guinea pigs, mice and domestic rabbits. (Ord. No. 99-404, § 1, 4-28-99) Sec. 6-52. Possession prohibited. (A) It shall be unlawful for any person to possess a wild animal in the city. (B) It is unlawful for an owner or other person in possession or control of any lot, unit or parcel of land in the city or any residence or business premises therein to knowingly suffer or permit any person to possess a wild animal property, residence or premises. (c) In this section, the term of possession includes any accommodation or maintaining a wild animal, whether on a temporary or permanent, and includes, without limitation, keeping or keeping wild animals at standstill temporary and / or limited purpose of sale or transfer or offer to sell or transfer to another person. (d) It is an affirmative defense to prosecution under this article that the wild animal is to be possessed in compliance with all state and federal laws and that: (1) The wild animal is kept for treatment in an animal hospital operated by a licensed veterinarian in Texas, (2) wildlife is maintained in a public zoo that is accredited by an association nationally recognized zoo, (3) The wild animal is kept in a shelter run by a state or federal government has recognized the humanitarian agency for its transfer to a refuge or sanctuary, (4) The wild animal is kept for medical research or teaching in a medical school or hospital or licensed by a university or college offering a curriculum accredited; (5) The wild animal is in possession of an air carrier, motor freight Agency, Rail Agency or other freight carrier and possession in the city is incidental to transport, provided that the wildlife is secured within a cage or other enclosure is enough to prevent his escape, or (6) The wild animal is kept or transported to temporary production under a license or registration under section 6-55 of this Code.
