If you can not settle the case with the insurance company of the owner of the dog, the next step is to start a trial court. Documents, called pleadings must be filed in court along with fees paid to the clerk of the court. These memories are called the summons and complaint. The summons informs the defendant that a lawsuit has been filed and that the response to this lawsuit is involved in a certain period of time (usually 20 days). The complaint describes the cause of action or legal theory that is charged to the person who is prosecuted, with a description of the facts that support this theory. A complaint must be reasonably specific to inform the defendant of the specific reasons support the claim.

The person who files a complaint is called the plaintiff. The dog owner who is sued is called the defendant. The applicant must arrange to personally serve a copy of the summons and complaint to the defendant. The plaintiff has a certain amount of time to resolve the claim or to sue, and personally served the defendant. In Washington, this time is generally 3 years from the date of the incident giving rise to the claim.28 This period is called the limitation period. In claims involving minors, the period limitation is generally pay (delayed) and only begin to run until the 18th birthday. Then the child three years until his 21st birthday to settle the claim or file a lawsuit.

It is dangerous to wait until the statute of limitations period is about to expire before the settlement of a complaint or a lawsuit. If a lawsuit is filed just before the date limit and if the defendant can not be found, or if the defendant is ill served, the case could be dismissed and the plaintiff would get nothing. For this reason, it may be prudent to hire a lawyer well before the limitation period expires. Many lawyers are unwilling to accept a case where the period of limitations is about to expire time because there may be insufficient to investigate the matter further files, search and personally serve the proper defendant. As such, it is in your best interest and in the best interest of this case as a whole, to get a lawyer as soon as possible.
